Abstract

ABSTRACT

 

                The objectives of this research were: 1) to study the general problems of the proficiency of environmental law enforcement of local administrative organizations according to r ja – sa gahavatthu, 2) to study the proficiency of environmental law enforcement of local administrative organizations according to
r ja – sa gahavatthu 4, the ruler’ bases of sympathy and 3) to propose the approaches to the effectiveness enhancing of the proficiency of environmental law enforcement of local administrative organizations according to r ja – sa gahavatthu 4.

                Methodology was the qualitative research, collected data from 24 key informants, purposefully selected from 4 groups of experts; 1. From high ranking officers in local administrative organizations in Bangkok Metropolitan Administration, 2. Academicians who were experts in environmental law enforcement,
3. Academicians, experts in public administration and 4. The Buddhism knowledge monks. The tools used to collect data were structured in-depth-interview, collecting data by face-to-face in-depth interviewing and analyzing data by descriptive interpretation.

            Findings were as follows:

                1) The general problems of environmental law enforcement could be summarized into three problems; (1) there was not consistency and unity of the law that causes the redundancy of the law itself and the law enforcement, (2) the law was not appropriate to the present situation owing the law was obsolete that caused the problems of interpretation and the rate of punishment fee was not appropriate and (3) the problems caused by authority of the law enforcement in the areas of judgment usages on damage and the surcharge of damage fee. 

                2) The general problems of the proficiency of environmental law enforcement of local administrative organizations according to r ja – sa gahavatthu were; the environmental laws were not in uniformity causing the redundancy and duplication in enforcing the laws that caused 3 problems as
1. The problems of administration, 2. The problem of the environmental law enforcement and 3. The problems from the law enforcement officers themselves. 

                3) Buddhadhamma that were appropriated to the proficiency of environmental law enforcement of local administrative organizations according to
r ja – sa gahavatthu 4, as follows;

                   1) Sassametha, shrewdness in agricultural promotion with the appropriate process of knowledge development.

                   2) Purisamedha, chrewdness in the promotion and encouragement of government officials, referring to the administrators know how to use and promote the good and competent persons to work effectively.

                   3) Sammapasa, a bond to bind men's hearts, which means the leaders are clever in policy planning to bind men's hearts by appropriate occupational promotion for the prosperity of population.

                   4) Vajapeya, affability in address; kindly and convincing speech, which means the leaders must know the technique of good and rousingly convincing speech.
